North Dakota Last Will and Testament Form

North Dakota last will and testament allows a person to arrange for the distribution of their property after their death. The instructions in a will, as it is more commonly known, are legally binding, and mean that the decedent’s assets avoid the intestate succession process. In the terms of estate law, the person who creates the will is known as the testator, while the people or organizations who receive property under a will are called beneficiaries.

Laws Chapter 30.1-08 (Wills)

Signing Requirements (§ 30.1-08-02) – Wills must be in writing and signed by the testator. The testator must sign either in the presence of a notary, or in the presence of two witnesses who sign the document within a reasonable time of the testator.
