Alabama Last Will and Testament Form

An Alabama last will and testament allows a person (testator) to choose where assets and property will transfer after death. This is most common to be the spouse or close family but can also be to organizations (such as non-profits) and expressly prohibit some family members from receiving an inheritance.

After the testator’s death, the latest version of their last will and testament will be used to distribute the assets as part of the probate process. The executioner named in the document will be the person who will take the lead in distributing the assets. After the assets are transferred to the beneficiaries, the probate process will be considered complete.

Signing Requirements

A last will and testament must be signed in the presence of two (2) witnesses (§ 43-8-131).
